A Pennsylvania man was arrested Tuesday night after police found him driving under the influence on a bicycle.
Trevor Joseph Kruis, 19, was spotted by police at about 10:52 p.m. riding his bike in traffic. When officers stopped him, he showed signs of “being highly under the influence of alcohol and a controlled substance.”
According to police, Kruis allegedly resisted arrest causing the officers to use a Taser on him.
Kruis was charged with driving (that’s right, driving) under the influence of alcohol or a controlled substance, possession of a controlled substance and resisting arrest.
You might be asking yourself, “But he was on a bike?”
Unfortunately, that doesn’t matter, even in California.
But you won’t be charged under California’s DUI laws, Vehicle Code sections 23152(a) and 23152(b). A bicycle is not considered a vehicle under the code and is therefore not subject to laws that pertain only to vehicles.
However, California Vehicle Code section 212500 states in pertinent part, “…it is unlawful for any person to ride a bicycle upon a highway while under the influence of an alcoholic beverage or any drug, or under the combined influence of an alcoholic beverage and any drug. Any person arrested for a violation of this section may request to have a chemical test made of the person’s blood, breath, or urine for the purpose of determining the alcoholic or drug content of that person blood…”
A charge of 212500.5 is classified as a misdemeanor and if convicted maximum fine is $250 with no jail time.
