DUI Suspects’ Plan to Outsmart Cops

|

Petaluma police arrested two people Saturday who allegedly took turns driving a vehicle while intoxicated. The 28-year-old driver, Rudolf Giancola, showed signs of intoxication when he was found on the 800 block of Petaluma Boulevard North, according to Sgt. Novello.

Giancola had a passenger in the car with him at the time of the arrest. Wisconsin resident Mary Stewart, 28, also appeared to be intoxicated, and officers determined she was behind the wheel during the hit-and-run collision, according to Novello.

Stewart and Giancola allegedly switched seats on Petaluma Boulevard North after the crash, “due to Stewart’s state,” Novello said.
The pair had blood alcohol levels that were more than twice the legal limit in California, according to the chemical test used by police.

Giancola and Stewart were both arrested and booked at the Sonoma County Jail on charges of driving under the influence, Novello said.
Police said Giancola was on probation for an earlier DUI offense.

“DUI continue to plague California roadways,” the police department said in a statement announcing the two arrests. “Bottom line: Do not drink and drive.”

In California, there are various ways to violate the DUI laws depending on the type of substance consumed, or even the classification of the driver. While California laws are consistently changing as it relates to DUI, here is a list of the various laws created to criminalize driving under the influence.
